1Who We Are
Tru Food Co is operated by The Real Us Standards, LLC, a limited liability company organized in the State of CA. You can reach us at team@trufoodco.com or 951-422-7146.
2Eligibility
You must be at least 18 years old and able to form a binding contract to create an account or place an order. By using the app you confirm that the information you provide (name, delivery address, phone, email) is accurate and current.
3Our Service
We prepare and deliver fresh meals, overnight oats, bulk proteins, and specials on a weekly schedule to select delivery areas. The app also offers optional wellness tools (meal tracking, a protein calculator, a fasting schedule, weight logging, and reminders). These tools are for general wellness and convenience only and are described further in Section 11.
4Ordering, Cutoff & Delivery
- Weekly cutoff. Orders for a given Sunday delivery must be placed by the posted cutoff (currently Wednesday). Orders or changes made after the cutoff apply to the next available delivery week.
- Delivery area. We deliver only to the ZIP codes shown as eligible at signup. If your address falls outside our zone, we cannot fulfill delivery.
- Delivery windows. We aim to deliver on the scheduled day but do not guarantee a specific time. We are not liable for delays caused by weather, traffic, incorrect addresses, or other events outside our reasonable control.
- Receipt of food. You are responsible for providing accurate delivery details and for promptly refrigerating perishable items upon delivery. We are not responsible for food left unrefrigerated after delivery.
5Pricing & Payment
- Prices are shown in the app and are subject to change without notice. The price that applies to your order is the price shown at the time you check out.
- Stripe and Apple process payments. We do not store your full card number; it is handled by our payment processor.
- You authorize us (through our payment processor) to charge your selected payment method for the total shown at checkout, including any applicable delivery fee and taxes.
6Subscriptions & Auto-Renewal
If you turn on auto-subscribe, you authorize a recurring weekly charge to your payment method for the order generated each week, until you cancel. You may choose "Surprise me" (we select meals to your set count) or hand-pick your meals per rotation week. You are responsible for reviewing your selections and count.
- Cancellation / changes take effect for any week where you make them before the weekly cutoff. Changes after the cutoff apply to the following week.
- You can pause or cancel auto-subscribe at any time in the app. It is your responsibility to cancel before the cutoff to avoid the next week's charge.
7Refunds & Cancellations
We handle refunds and cancellations on a case-by-case basis. If something is wrong with your order, contact us at team@trufoodco.com within 24 hours of delivery and we will work with you in good faith.
- Because we prepare fresh, perishable food to order, we generally cannot accept returns. Resolutions may include a credit, replacement, or refund at our discretion.
- Orders cancelled before the weekly cutoff are not charged (or are refunded if already charged). Orders cancelled after the cutoff may not be refundable because preparation has begun.
8Coupons, Referrals & Loyalty Rewards
- Coupons and reward codes have no cash value, cannot be exchanged for cash, and cannot be combined or stacked. One coupon may be applied per weekly order.
- Referrals: when a friend signs up with your code and places their first order, both of you receive the referral reward described in the app. Rewards are issued only after the referred friend actually orders.
- Loyalty rewards unlock based on the number of your referred friends who continue ordering, as described in the app, up to the stated cap.
- We may modify, suspend, or end any promotion, referral, or loyalty program at any time, and we reserve the right to withhold rewards we reasonably believe were obtained through fraud, abuse, self-referral, or violation of these Terms.
9Food Safety & Allergens
Allergen warning. Our food is prepared in a kitchen that handles common allergens including nuts, dairy, eggs, gluten, soy, and shellfish. We cannot guarantee that any item is free from these allergens or from cross-contact.
- If you have a food allergy or intolerance, you are responsible for reviewing ingredients and for deciding whether an item is safe for you. If in doubt, contact us before ordering. Do not order if you cannot safely consume foods prepared in a shared kitchen.
- Nutrition and macro values shown in the app are estimates and may vary with portion size and preparation.
- Refrigerate perishable items promptly and follow any storage or reheating guidance we provide. Consume by any "use by" date communicated.
10Your Account
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You agree not to misuse the app, attempt to access other users' data, interfere with the service, or use it for any unlawful purpose.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraud or abuse.
11Wellness Tools Are Not Medical Advice
The protein calculator, fasting schedule, meal/macro tracking, weight log, and reminders are provided for general wellness and informational purposes only. They are not medical, nutritional, or healthcare advice, and they are not a substitute for consultation with a qualified professional.
Do not start a fasting or diet program based on the app without first consulting your doctor, especially if you are pregnant or breastfeeding, have diabetes or take blood-sugar or blood-pressure medication, have a history of disordered eating, are under 18, or have any medical condition.
Stop and seek care if you feel unwell. You use these tools at your own risk, and you are solely responsible for decisions you make based on them.
12Health Information & Privacy
Information you enter into wellness tools (such as weight and eating logs) and the personal details you provide are handled as described in our Privacy Policy. By using the app you consent to that handling. We do not sell your personal information.
13Intellectual Property
The app, the Tru Food Co name and logo, menus, content, and design are owned by us or our licensors and are protected by law. You may not copy, reproduce, or use them without our written permission, except as needed to use the app normally.
14Disclaimers
To the fullest extent permitted by law, the app and our products are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any wellness result will be achieved.
15Limitation of Liability
To the fullest extent permitted by law, The Real Us Standards, LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the app or our products. Our total liability for any claim will not exceed the greater of the amount you paid us for the order giving rise to the claim or $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
16Indemnification
You agree to indemnify and hold harmless The Real Us Standards, LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the app, your violation of these Terms, or your violation of any law or the rights of another.
17Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and material changes may be communicated in the app. Your continued use after changes take effect means you accept the updated Terms.
18Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of CA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in San Bernardino County, CA, and you consent to that jurisdiction.
1. Agreement to Arbitrate
You and The Real Us Standards, LLC (collectively, "the Parties") agree that any dispute, claim, or controversy arising directly out of or relating to these Terms, the subscription service, or the physical meal products delivered to you shall be settled exclusively by binding individual arbitration. This agreement is governed by the Federal Arbitration Act (FAA).
2. Class Action Waiver
YOU AND The Real Us Standards, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of a class or representative proceeding.
3. Mandatory Pre-Dispute Informal Resolution
Before initiating an arbitration or court proceeding, you and The Real Us Standards, LLC agree to make a good-faith effort to resolve any dispute informally.
- Notice of Dispute: The initiating party must send a written "Notice of Dispute" detailing the claim to team@trufoodco.com.
- 30-Day Meet-and-Confer: Following delivery of the notice, both parties agree to wait thirty (30) days and engage in an informal "meet-and-confer" conference (via phone or video) to attempt a settlement.
- Condition Precedent: Completion of this 30-day informal negotiation period is a mandatory condition precedent that must be fulfilled before filing for arbitration or small claims court.
4. Mandatory Allergen Acknowledgment and Scope
By checking the box to agree to these Terms, you explicitly acknowledge that:
- Menu Disclosures: The Real Us Standards, LLC clearly lists ingredients and potential allergens on its digital and physical menus.
- Assumption of Risk: You assume the sole responsibility to review the menu carefully for ingredients that may cause you or your household members an allergic reaction.
- Binding Individual Scope: Any individual claim arising from an allergic reaction, food borne illness, or physical injury related to food consumption must be resolved strictly via individual arbitration under Section 1. You waive the right to consolidate allergen or food safety claims with any other consumer.
5. California Venue, Fees, and Rules
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
- California Venue: Pursuant to California Senate Bill 940, the arbitration venue shall be located in the California county of your residence.
- The 30-Day Payment Rule: The Real Us Standards, LLC will promptly pay all AAA administrative fees. In accordance with California Code of Civil Procedure §§ 1281.97 and 1281.98, The Real Us Standards, LLC acknowledges that failure to pay these arbitration fees within thirty (30) days of their due date constitutes a material breach of contract, a waiver of the right to arbitrate, and subjects the company to court litigation and severe statutory sanctions.
6. 30-Day Right to Opt Out
You may opt out of this Agreement by sending a written notice to team@trufoodco.com within thirty (30) days of creating your account.
7. Severability
If any court or arbitrator finds any portion of this Class Action Waiver or Arbitration Agreement unenforceable, that specific portion shall be severed, and the remaining individual claims shall continue to be arbitrated.
